Standing Committee on Information Technology issued its own report challenging this proposed amendment:"...Under the proposed amendments, the intermediaries/service providers shall not be liable for any third party information data.... The Committee do not agree with this. What is relevant here is that when [the] platform is abused for transmission of allegedly obscene and objectionable contents, the intermediaries/service providers should not be absolved of responsibility. The Committee, therefore, recommend that a definite obligation should be cast upon the intermediaries/service providers in view of the immense/irreparable damages caused to the victims through reckless activities that are under taken in the cyberspace by using the service providers' platform. Casting such an obligation seems imperative...." (pp. 54-55)

ReplyDeleteThis is usual oneside crying of ISPs, who does not want to be governed by regulations. Internet is bound to grow, whether google likes it or not. If google is unhappy and would like to quit/downscale, some one else will come.
ReplyDeleteWhat is the harm in "due diligence" being in main act against desired in guidelines, as said by MoIT. ISPs talk of self-regulation, which the committee rightly said as eye-wash. No self-regulation works anywhere, at least in India.
Further, Internet is much more than Telephone / Postal services, as anology given by ISPs. You can not compare apples and oranges.

The recommendations made by the Parliamentary committee are largely sensible and reverses the motivated amendments suggested by the Minstry earlier.
